Farm liability insurance can help protect you and your assets from lawsuits and losses caused by bodily injury and property damage. You can choose from different types of liability insurance tailored to your needs. As a result, you can rest assured that your business, home, property and investments are protected in a variety of situations.

As a farmer or rancher, you should consider different types of liability insurance as some might fit your needs better than others. Keep in mind that an AgriChoice® farm policy provides general farm liability coverage for premises and operations liability.1 It also provides some limited farm product liability coverage.

Premises liability

You may be held responsible if someone is injured or has property damaged because of the physical condition of your farm or ranch. A common example is a visitor who slips and falls on your property.

One area of premises liability that deserves special consideration is agritourism. Generally, activities that go along with agritourism aren’t covered by your farm or ranch policy. This additional coverage can provide protection for most types of agritourism, however. Talk to your agent about all the activities that take place on your farm or ranch to make sure your operation is properly covered.

Operations liability

You may also be held responsible for injury or property damage caused by some aspect of your farm or ranch operations. A prime example is an incident caused by farm machinery on a roadway. If you’re traveling on roadways often, for example, if a public road runs through your fields and you use it to move farm equipment to various fields, this coverage can be beneficial. This coverage can be especially useful during mid to late summer during baling season, as hay balers and trailers are often traveling on public roads.

Farm product liability

While your farm policy provides some product liability protection, this coverage only applies to produce that you grow on your property, then sell in an unprocessed condition. For instance, if you’re selling apples to the public that you grew in your orchard, your general farm insurance policy would provide product liability coverage if your produce somehow causes injury or illness. On the other hand, if you use those apples to make apple cider, apple butter or some other processed product, you’d need to add commercial liability coverage to your farm policy.

Pollution liability

Pollution liability insurance covers injuries or property damage that results from the escape of pollutants directly from your farm or while in transit. Government regulations also consider you responsible for pollution cleanup.2

Umbrella liability

In the event of an accident in which you are held responsible for damages or bodily injuries, an umbrella liability insurance policy will help protect your assets. Umbrella coverage will also help pay for damages you are legally responsible for if another party files a lawsuit against you.

An umbrella policy is particularly useful if your farm or ranch vehicles are already insured with us. That’s because umbrella liability insurance can be added to your Nationwide agribusiness liability policy as an additional layer of liability protection. It’s usually less expensive than higher-limit liability policies. Talk to your agent to learn more.

Unfounded animal abuse allegations

As part of every AgriChoice policy, protection against unfounded animal cruelty lawsuits is available at no additional cost. In the event of a lawsuit, you will be provided reimbursement up to your endorsement limits to help offset attorney fees as long as you are found not guilty. This applies to civil or criminal claims.
